1. About TinyTunes
TinyTunes operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with personalized songs, animated characters, videos, and related products and services (collectively, the "Services").
TinyTunes is powered by Shopify, which provides the ecommerce platform used to operate our store and process transactions.
This Privacy Policy describes how TinyTunes collects, uses, stores, and discloses personal information when you visit, use, or make a purchase or other transaction through the Services, or otherwise communicate with us.
If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, storage, and disclosure of personal information.
2. Personal Information We Collect or Process
When we use the term "personal information," we mean information that identifies, relates to, describes, or can reasonably be linked to you or another person.
Depending on how you interact with the Services, we may collect or process the following categories of information:

Photographs and Photo Likeness information, if you voluntarily choose to use our optional Photo Likeness feature. This may include a photograph of a child and information derived from or processed from that photograph for the purpose of generating an animated character designed to resemble the child.
Communications, including information contained in emails, customer support requests, messages, and other communications you send to us.
Device and technical information, including information about your device, browser, operating system, network connection, IP address, and other technical identifiers.
Usage information, including information about how and when you interact with the Services, including pages viewed, products viewed, products added to a cart, purchases, and other interactions.
3. Sources of Personal Information
We may collect personal information from the following sources:
Directly from you, including when you create an order, use our Services, communicate with us, upload content, or otherwise provide information to us.
Automatically through the Services, including through cookies, pixels, analytics tools, and similar technologies.
From our service providers, including companies that provide technology, hosting, payment processing, customer support, analytics, content generation, and other services on our behalf.
From advertising and analytics partners, including information relating to your interaction with our website and advertisements.
From other third parties when permitted by law or when you direct or authorize us to receive information.
4. How We Use Your Personal Information
Depending on how you interact with TinyTunes, we may use personal information for the following purposes:
Provide and fulfill the Services.
We use personal information to process purchases, fulfill orders, create personalized songs and videos, create animated characters, provide previews, deliver purchased content, communicate with you about your order, provide customer support, and otherwise provide the Services you request.
Create personalized content.
We use the information you provide, including names, song details, character selections, occasions, and other optional information, to create personalized songs, characters, images, and videos.
Photo Likeness.
If you voluntarily choose to use our Photo Likeness feature, we use the photograph you provide for the limited purpose of generating an animated character designed to resemble the child shown in the photograph.
Photo Likeness is optional. You may choose to use our standard character creator instead, which creates a stylized character from the options you select without requiring a photograph.
Improve and maintain the Services.
We may use personal information to maintain, troubleshoot, analyze, secure, and improve the Services, subject to applicable law.
Communications.
We may use your contact information to communicate with you about your orders, account, customer support requests, changes to our Services, and other service-related matters.
Marketing and advertising.
We may use certain customer information for marketing and advertising purposes, including sending promotional communications where permitted by law and showing advertisements for TinyTunes products or services.
We and our advertising and analytics partners may use cookies, pixels, and similar technologies to understand website activity, measure advertising performance, and deliver or improve advertising.
Where permitted by applicable law, a securely hashed version of contact information such as an email address may be shared with advertising partners for audience matching and measurement.
We do not use a child's photograph, Photo Likeness information, or biometric information for advertising or targeted marketing.
Security and fraud prevention.
We may use personal information to maintain account and transaction security, detect or investigate fraud or abuse, prevent unauthorized activity, protect the Services, and comply with applicable security requirements.
Legal purposes.
We may use and disclose personal information when reasonably necessary to comply with applicable law, respond to valid legal process, enforce our agreements and policies, protect our rights or property, investigate potential violations, or protect the safety of our customers or others.
5. How We Create Your Personalized Content
For standard TinyTunes orders, you provide information such as a child's first name, optional details, song information, and character selections.
Our standard character creator creates a stylized, fictional character based on the options you select. The standard character is not intended to represent or identify a particular real child.
Optional Photo Likeness Feature
TinyTunes also offers an optional Photo Likeness feature that allows an adult customer to upload a photograph so that we can create an animated character designed to resemble the child shown in the photograph.
The Photo Likeness feature may be used to create a preview before you decide whether to purchase the completed movie or video.
Before uploading a photograph, you must affirmatively confirm that you are the child's parent or legal guardian, or that you otherwise have legal authority to provide the required consent on the child's behalf.
You must provide this consent before the photograph is uploaded or processed.
The Photo Likeness feature is optional. If you cannot make this authorization or do not wish to provide a photograph, you may use the standard character creator instead.
6. Photo Likeness, Facial Information, and Biometric Privacy
A photograph may contain facial characteristics. Depending on how information is processed and the law applicable to a particular individual or transaction, information derived from a photograph may constitute biometric information or a biometric identifier.
TinyTunes does not treat every photograph automatically as biometric information under every law. Where applicable law treats information processed through the Photo Likeness feature as biometric information or a biometric identifier, TinyTunes will handle that information in accordance with applicable legal requirements.
Before collecting or processing a photograph through Photo Likeness, TinyTunes provides a separate Photo Likeness & Biometric Privacy Notice describing the purpose of the processing, retention practices, consent process, third-party processing, security measures, and other relevant information.
The Photo Likeness & Biometric Privacy Notice is incorporated by reference into this Privacy Policy with respect to the Photo Likeness feature.
TinyTunes does not use Photo Likeness information for facial recognition, identity verification, tracking individuals across unrelated services, advertising profiles, or unrelated commercial purposes.
TinyTunes does not sell, lease, trade, or otherwise sell for profit biometric identifiers or biometric information collected through the Photo Likeness feature.
7. Photo Likeness Consent
Before uploading a photograph through Photo Likeness, the adult customer must affirmatively acknowledge the applicable consent statement.
The consent process requires the customer to confirm that they are the child's parent or legal guardian, or otherwise have legal authority to consent on the child's behalf.
TinyTunes may maintain a record of consent, including the date and time of consent, the version of the consent language and privacy notice presented, and information reasonably necessary to document the consent.
Where applicable law requires a written release or other authorization, TinyTunes will obtain the applicable electronic consent or release before processing the photograph, to the extent permitted by applicable law.
8. Third-Party AI and Technology Providers
TinyTunes uses third-party technology providers to provide certain parts of the Services.
Depending on the product or feature you use, third-party providers may process information needed to:
Generate song lyrics.
Generate personalized artwork or animated characters.
Generate a Photo Likeness character.
Generate music and audio.
Create animated video content.
Host, deliver, store, or process customer content.
Provide customer support, analytics, security, payment processing, or other services.
These providers receive information necessary to perform the services for which they are engaged.
Photo Likeness and xAI
When you use Photo Likeness, the photograph you provide may be transmitted securely to our third-party image-generation provider, xAI, through its API so that the requested personalized character can be generated.
TinyTunes' xAI account is configured for Zero Data Retention (ZDR).
Under xAI's ZDR configuration, xAI does not persist API request inputs or outputs for the normal 30-day audit-retention period. ZDR is applied at the team level and applies to API requests made using API keys belonging to that team.
TinyTunes does not authorize xAI to use submitted customer photographs to train its models.
xAI states that it does not train on API inputs or outputs without explicit customer permission.
TinyTunes may use other third-party providers for other portions of the song, image, or video-generation process. Those providers may have their own privacy policies and technical practices. We configure and use providers in a manner intended to limit customer content to the purposes for which the provider is engaged, subject to the provider's applicable terms and our contractual arrangements.
9. Retention and Deletion of Photo Likeness Information
TinyTunes is designed to retain uploaded photographs only for as long as reasonably necessary to provide the Photo Likeness feature and fulfill the requested service.
The original uploaded photograph is used only for the brief period required to generate your personalized character. TinyTunes deletes the original uploaded photograph from TinyTunes-controlled systems immediately after that conversion process completes — it is not retained afterward, unless a longer period is reasonably necessary for security, fraud prevention, customer support, legal compliance, or another legitimate operational purpose.
The animated character generated from your photograph is a separate, newly created image rather than the photograph itself. Because that generated character is used throughout your personalized video, TinyTunes retains it — along with the resulting personalized video and related order information — for as long as reasonably necessary to provide, deliver, support, and administer your purchase.
Because TinyTunes' xAI account is configured for Zero Data Retention, xAI does not independently retain API request or response content after processing under the ZDR configuration.
TinyTunes' own retention and deletion practices govern content stored within TinyTunes-controlled systems.
10. Biometric Retention and Destruction Policy
To the extent TinyTunes possesses biometric identifiers or biometric information subject to applicable biometric privacy law, TinyTunes maintains a publicly available retention and destruction policy.
TinyTunes will retain such information only for the period reasonably necessary to fulfill the specific purpose for which it was collected or obtained, subject to applicable legal requirements.
TinyTunes will permanently delete or destroy applicable biometric identifiers and biometric information when the initial purpose for collecting or obtaining the information has been satisfied or within three years of the individual's last interaction with TinyTunes, whichever occurs first, unless a longer retention period is required or permitted by applicable law, a valid warrant or subpoena, or another lawful exception.
When the applicable purpose has been satisfied, TinyTunes will take reasonable steps to permanently delete or destroy applicable biometric information from systems under its control.
11. Information We Do Not Use for Advertising
TinyTunes does not use the following information for advertising or targeted marketing:
A child's photograph.
Photo Likeness information.
Biometric identifiers or biometric information.
A child's personalized character or likeness information.
We also do not provide a child's photograph or Photo Likeness information to advertising partners for audience matching, targeted advertising, or advertising measurement.
12. How We Disclose Personal Information
We may disclose personal information to third parties when reasonably necessary to provide the Services or for other purposes described in this Privacy Policy.
These disclosures may include:
Shopify and other ecommerce providers.
Payment processors and financial service providers.
Cloud hosting and storage providers.
AI and content-generation providers.
Video and image-processing providers.
Customer support providers.
Analytics providers.
Security and fraud-prevention providers.
Advertising and marketing partners, where permitted by applicable law and subject to the limitations described in this Privacy Policy.
Business partners and service providers who perform services on our behalf.
Government authorities or other parties when disclosure is required by law or valid legal process.
Professional advisors, including attorneys, accountants, auditors, insurers, and similar service providers.

We do not sell, lease, or trade a child's photograph or Photo Likeness information.
We do not sell biometric identifiers or biometric information collected through the Photo Likeness feature.
13. Relationship With Shopify
The Services are hosted and powered in part by Shopify.
Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve its platform and related services.
Information you submit through the Services may be transmitted to and processed by Shopify and other third-party providers located in countries other than where you live.
Shopify may also process information relating to your interactions with our store and other Shopify merchants in accordance with Shopify's own privacy practices.

14. Cookies, Pixels, and Analytics

16. Children's Privacy
TinyTunes is designed for adults who create personalized songs and videos for children.
The Services are not designed for children to create accounts, place orders, upload photographs, or submit personal information directly to TinyTunes.
Our standard character creator does not require a photograph of a child.
The Photo Likeness feature is intended to be used by an adult. Before a photograph is uploaded, the adult must affirmatively confirm that they are the child's parent or legal guardian, or otherwise have legal authority to consent to the processing described in the applicable Photo Likeness & Biometric Privacy Notice.
If you believe that information or content relating to a child was submitted without appropriate authorization, please contact us so that we can review the situation and take appropriate action.
17. COPPA
TinyTunes is designed for adults and does not knowingly solicit personal information directly from children under 13 through the Services.
Information about a child may be provided to TinyTunes by an adult customer for the purpose of creating a personalized product.
The federal Children's Online Privacy Protection Act (COPPA) primarily regulates the online collection of personal information from children under 13 by covered websites and online services.
TinyTunes nevertheless takes children's privacy seriously and applies the protections and restrictions described in this Privacy Policy to information provided about children.
18. Security
TinyTunes uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction.
We use secure connections when transmitting information to our technology providers.
Access to customer information is limited to systems, service providers, and personnel who reasonably need access to provide, maintain, secure, or support the Services.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
19. Retention of Other Personal Information
We retain personal information for as long as reasonably necessary to provide the Services, fulfill orders, maintain business and transaction records, provide customer support, resolve disputes, enforce agreements, prevent fraud, maintain security, and comply with applicable legal obligations.
Character selections and ordinary order details may be retained as needed to generate, deliver, and support your order.
Preview links may expire automatically according to the applicable preview period.
Finished songs, videos, and related order records may be retained as reasonably necessary to provide and administer your purchase and support requests.
You may request deletion of personal information that TinyTunes maintains, subject to applicable legal requirements and legitimate exceptions.
20. Your Privacy Rights and Choices
Depending on where you live, you may have some or all of the following rights regarding your personal information:

Even if you opt out of promotional communications, we may continue to send non-promotional communications relating to your orders, purchases, account, security, or customer support.

We will review the request and, where appropriate and legally permitted, delete or remove the applicable information or content.

23. Do Not Sell or Share Children's Photo Likeness Information
TinyTunes does not sell or share a child's photograph, Photo Likeness information, or biometric identifiers or biometric information for targeted advertising.
We do not use a child's photograph or Photo Likeness information to create advertising audiences.
We do not provide children's Photo Likeness information to advertising partners.
24. International Transfers
TinyTunes and its service providers may store or process personal information in countries other than the country where you live.
Some of our technology providers may operate infrastructure in the United States or other countries.
Where applicable law requires specific safeguards for international transfers, TinyTunes will use legally recognized transfer mechanisms or other appropriate safeguards.

We may update this Privacy Policy from time to time to reflect changes to our Services, technology, privacy practices, legal requirements, or business operations.

If you choose to give us your mobile number, we use it only to send you texts about your order (for example, when your movie is ready). No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with any third parties.
