Welcome to Tiny Tunes. These Terms of Service ("Terms") are a legal agreement between you and "Tiny Tunes," "we," "us," or "our," the operator of tinytunesongs.com (the "Site"). They govern your access to and use of the Site and your purchase of our personalized songs, videos, animated characters, and related products and services (collectively, the "Services").
By using the Site, placing an order, or checking the box agreeing to these Terms at checkout, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Photo Likeness & Biometric Privacy Notice, and our Refund & Happiness Guarantee.
If you do not agree with these Terms, please do not use the Site or purchase our Services.
1. Who Can Use Tiny Tunes
You must be at least 18 years old and able to form a legally binding contract to purchase from us. By placing an order, you represent that you meet these requirements and that all information you provide is accurate and complete.
Tiny Tunes is intended for adults creating personalized content for children. This may include parents, grandparents, family members, friends, or other adults creating a gift for a child.
The Services are not directed to or intended for use by children. Children may not create accounts, place orders, or directly submit photographs or other personal information to Tiny Tunes.
For ordinary personalized songs and videos, you are responsible for ensuring that you have the appropriate permission to provide information about a child and authorize us to create personalized content featuring that child.
The optional Photo Likeness feature has additional authorization and consent requirements described below.
Tiny Tunes is a family-owned business based in the United States.
2. How Personalized Products Work
Our songs, animated characters, and videos are made to order and personalized using information you provide, such as a child's first name, optional details you choose to share, the occasion, and the character options you select, including character look, age range, outfit, and other available choices.
You are responsible for the details you submit. Please review names, spellings, pronunciation choices, character selections, and other personalization details carefully before purchasing.
We generate your product using the information and selections you provide.
Review Before Purchase
Before completing certain purchases, we may provide a preview of your personalized content and display generated lyrics or other personalization details so that you can review names, spellings, pronunciation choices, character selections, and other information.
It is your responsibility to review the information provided before completing your purchase.
Once production begins, your personalized content is created using the information and selections you approved.
Because every product is custom-made and AI-generated, personalization generally cannot be edited after production begins without creating a new version.
If you notice an error before purchasing, please generate a new preview or correct the information before completing your order.
Creative Results May Vary
Personalized songs, images, and videos are created using artificial intelligence and other automated creative technologies.
While we strive to produce high-quality personalized content, pronunciation, phrasing, lyrics, vocals, music, animation, character appearance, timing, and visual style are generated based on your inputs and may not exactly match your expectations.
No Exact Recreation
Because every song, image, and video is AI-generated, each creation is unique.
Once a song, image, or video has been generated, Tiny Tunes cannot guarantee that we can recreate an identical version or make isolated changes while preserving every other aspect of the original.
Any regenerated song, image, or video may be considered a new custom creation and may differ in lyrics, vocals, music, timing, visuals, animation, character appearance, or overall artistic style.
3. Information You Provide
For standard orders, Tiny Tunes does not require or collect a photograph of a child.
Standard personalized products are created from information such as the child's first name, optional details, occasion information, and the character options you select.
Photo Likeness Feature
Tiny Tunes may offer an optional Photo Likeness feature that allows an adult customer to upload a photograph of a child so that Tiny Tunes can generate an animated character designed to resemble the child.
The Photo Likeness feature is optional.
You may use the standard character creator instead, which creates a stylized character from the available character options without requiring a photograph.
Authorization Required
Before uploading a photograph through Photo Likeness, you must affirmatively confirm that you are the child's parent or legal guardian, or that you otherwise have legal authority to consent to the processing of the child's photograph and related information on the child's behalf.
You must provide this authorization and consent before the photograph is uploaded or processed.
If you cannot make this representation or do not wish to provide the required consent, you should not upload the photograph and may instead use the standard character creator.
Photo Likeness Preview
Photo Likeness may be available before you purchase the completed movie or video.
You may be able to upload a photograph, receive a personalized character preview, and review the result before deciding whether to purchase the completed personalized movie or video.
The availability of a Photo Likeness preview does not require you to purchase the completed product.
Your Responsibilities
You are responsible for the information and content you submit.
By providing information about a child, including a photograph through Photo Likeness, you represent and warrant that you have the legal right and authority to provide that information and, where applicable, to authorize Tiny Tunes to process the information and create personalized content featuring that child.
You agree not to submit information or content that you do not have the right or authority to use, or that infringes the privacy, publicity, copyright, trademark, or other rights of another person.
Generated Previews
Generated previews may be available for a limited period and may expire automatically according to the applicable preview period.
Unless otherwise stated for a particular product, preview links may expire approximately 48 hours after creation.
Full details about how Tiny Tunes handles personal information and uploaded photographs are provided in our Privacy Policy and Photo Likeness & Biometric Privacy Notice.
4. Photo Likeness and Biometric Information
The Photo Likeness feature involves processing a photograph that may contain facial characteristics.
Depending on how information is processed and the law applicable to the customer or transaction, information derived from a photograph may constitute biometric information or a biometric identifier.
Tiny Tunes does not treat every photograph automatically as biometric information under every law.
Where applicable law treats information processed through Photo Likeness as biometric information or a biometric identifier, Tiny Tunes will handle that information in accordance with applicable legal requirements.
Before a photograph is uploaded through Photo Likeness, the adult customer is presented with a separate Photo Likeness & Biometric Privacy Notice and required consent process.
That notice explains the purposes of processing, applicable retention and deletion practices, third-party processing, security practices, and other information relating to the Photo Likeness feature.
By completing the Photo Likeness consent process, you acknowledge that you have reviewed the applicable notice and provide the required authorization and consent to the extent permitted by applicable law.
Tiny Tunes does not use Photo Likeness information for facial recognition, identity verification, advertising profiles, or tracking individuals across unrelated services.
Tiny Tunes does not sell, lease, trade, or otherwise sell for profit biometric identifiers or biometric information collected through the Photo Likeness feature.
5. Photo Likeness Retention and Deletion
Tiny Tunes is designed to retain uploaded photographs only for as long as reasonably necessary to provide the Photo Likeness feature and fulfill the requested service.
For an unpaid Photo Likeness preview, Tiny Tunes intends to delete the original uploaded photograph and temporary photo-processing files from Tiny Tunes-controlled systems within approximately 24 hours after the preview is generated, unless a longer period is reasonably necessary for security, fraud prevention, customer support, legal compliance, or another legitimate operational purpose.
If you purchase a personalized movie or video, Tiny Tunes may retain the resulting personalized character, video, and related order information for as long as reasonably necessary to provide, deliver, support, and administer your purchase.
To the extent Tiny Tunes possesses biometric identifiers or biometric information subject to applicable biometric privacy law, Tiny Tunes will maintain and follow its applicable retention and destruction policy.
Tiny Tunes will permanently delete or destroy applicable biometric identifiers and biometric information when the initial purpose for collecting or obtaining the information has been satisfied or within three years of the individual's last interaction with Tiny Tunes, whichever occurs first, unless a longer retention period is required or permitted by applicable law, a valid warrant or subpoena, or another lawful exception.

6. Third-Party AI Processing
Tiny Tunes uses third-party technology providers to help provide the Services, including providers that may assist with lyrics, music, images, animation, video, hosting, email, payments, security, analytics, and other functions.
Photo Likeness may involve securely transmitting the uploaded photograph to a third-party AI image-generation provider so that the requested personalized character can be generated.
Tiny Tunes' xAI account is configured for Zero Data Retention (ZDR).
Under xAI's ZDR configuration, xAI does not persist API request inputs or outputs under its standard 30-day retention process.
Tiny Tunes does not authorize xAI to use submitted customer photographs to train its models.
Tiny Tunes may use other third-party providers for other portions of the song, image, or video-generation process. Those providers may have their own terms and privacy practices.

7. Content We Will Not Create
We want Tiny Tunes to be a safe and joyful product for families.
We reserve the right, to the extent permitted by law, to refuse, cancel, limit, or remove any order or content that we reasonably believe is:
- Illegal
- Fraudulent
- Hateful
- Threatening
- Harassing
- Defamatory
- Sexually explicit
- Exploitative
- Abusive
- Infringing of another person's rights
- Intended to impersonate or deceive
- Otherwise inappropriate for the Services
This includes photographs submitted through Photo Likeness that we reasonably believe do not depict the child represented by the customer, appear to have been submitted without appropriate authorization, or otherwise present a privacy, safety, legal, or security concern.
If we refuse or cancel an order for these reasons, we may issue a refund as described in our Refund & Happiness Guarantee.
8. Delivery Times
Any delivery or production time we mention on the Site, in emails, or at checkout is a good-faith estimate and is not a guarantee unless expressly stated otherwise.
Most personalized songs and videos are delivered promptly, but production times may vary because of demand, technical factors, quality-control processes, editing requirements, or third-party service availability.
We are not responsible for delays outside our reasonable control.
Where applicable, we will send your finished product to the email address associated with your order.
9. Force Majeure
Tiny Tunes is not responsible for delays, interruptions, or failures to perform resulting from events beyond our reasonable control.
These events may include internet outages, failures or interruptions involving third-party AI providers or cloud services, payment processor interruptions, cyberattacks, software failures, natural disasters, labor disputes, governmental actions, changes to third-party services, or other unforeseen circumstances.
In such cases, we will make reasonable efforts to resume service as quickly as practicable.
10. Pricing and Payment
Prices are listed on the Site and may change at any time.
The price that applies to your order is the price shown at the time you complete checkout.
Payments are processed through our payment providers.
Tiny Tunes does not store your full payment card number unless expressly stated otherwise through a specific payment service.
You agree to provide accurate billing, payment, and contact information.
11. Refunds & Happiness Guarantee
We want every Tiny Tunes customer to love their personalized song and video.
If you are not satisfied with your purchase, please contact us in accordance with our Refund & Happiness Guarantee.
Where applicable, we may provide revisions, replacement content, or a refund as described in that guarantee.
Because each Tiny Tunes creation is a unique AI-generated work, regenerated songs, images, and videos will be newly generated versions rather than guaranteed exact recreations of a previous generation.
A regenerated version may differ in lyrics, vocals, music, timing, visuals, animation, character appearance, or overall artistic style.
Our complete Refund & Happiness Guarantee is incorporated into these Terms by reference.
If you receive a full refund and we agree to permanently remove your personalized content as part of that refund, we may permanently remove the applicable song, video, and associated download or share links from our systems.
Once deleted, content may not be restorable or accessible again.
12. Intellectual Property and Your License to Use
When you purchase a personalized song or video, Tiny Tunes grants you a worldwide, non-exclusive, non-transferable, royalty-free license to download, play, display, and share your finished product for your own personal, non-commercial use.
This includes sharing the finished product with family and friends and playing it at private events.
You may not sell, sublicense, distribute for commercial purposes, modify for resale, remove Tiny Tunes branding where prohibited, or otherwise commercially exploit your personalized product without our prior written permission.
You retain rights in the personal information and content you provide, subject to applicable law and the rights of any other person who may have rights in that information or content.
By submitting information or content to Tiny Tunes, you grant Tiny Tunes a limited, non-exclusive license to use that information and content solely as reasonably necessary to generate, produce, deliver, maintain, secure, and support your order and provide the Services.
This license does not authorize Tiny Tunes to sell your personal information or use a child's photograph or Photo Likeness information for advertising or unrelated commercial purposes.
Except for the limited rights described above, all rights, title, and interest in the Tiny Tunes website, software, AI workflows, prompts, production methods, designs, branding, logos, trademarks, templates, and other proprietary technology remain the property of Tiny Tunes or its licensors.
Nothing in these Terms transfers ownership of Tiny Tunes intellectual property to you.
13. Third-Party Services
We use third-party providers to operate portions of the Services, including providers that assist with music, lyrics, images, animation, video, hosting, cloud storage, email, payments, analytics, security, and customer support.
Your use of the Services may involve processing by these providers.
Our Privacy Policy and Photo Likeness & Biometric Privacy Notice describe the relevant categories of third-party processing.
Third-party services may have their own terms, privacy policies, and service limitations.
To the extent permitted by law, Tiny Tunes is not responsible for independent acts, policies, outages, or practices of third-party providers.
14. Acceptable Use
You agree not to misuse the Site or Services.
You may not:
- Attempt to disrupt, damage, overload, or gain unauthorized access to our systems
- Use the Services for unlawful purposes
- Attempt to circumvent security or access controls
- Resell or commercially exploit the Services without permission
- Upload malware, viruses, or other malicious code
- Submit content you do not have the right or authority to submit
- Submit a child's photograph through Photo Likeness without the required authorization
- Use the Services to infringe the privacy, publicity, copyright, trademark, or other rights of another person
- Attempt to use Photo Likeness for facial recognition or identification
- Use the Services in a manner that violates applicable law
15. Disclaimers
The Site and Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law.
Tiny Tunes disclaims warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot lawfully be excluded.
We do not warrant that the Services will be uninterrupted or error-free or that every personalized product will meet your subjective expectations.
AI-generated content may contain unexpected errors, variations, inaccuracies, pronunciation issues, visual differences, or creative results that differ from your expectations.
16. Limitation of Liability
To the fullest extent permitted by law, Tiny Tunes and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill arising out of or relating to your use of the Site or Services.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid to Tiny Tunes for the order giving rise to the claim.
Nothing in these Terms is intended to limit liability that cannot legally be limited or excluded under applicable law.
17. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Tiny Tunes and its owners, employees, and contractors from and against claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:
(a) your violation of these Terms;
(b) content or information you submit;
(c) your violation of another person's rights;
(d) your misuse of the Services; or
(e) your breach of the representations or warranties you make under these Terms.
This includes claims arising from your failure to have the necessary right or authority to provide information about a child or submit a photograph through Photo Likeness.
18. Privacy
Your use of the Services is also governed by our Privacy Policy.
Our Privacy Policy explains what information we collect, how we use and disclose it, our use of cookies and similar technologies, our retention practices, and applicable privacy rights.
Use of the Photo Likeness feature is additionally governed by our Photo Likeness & Biometric Privacy Notice.
Please review both notices carefully before using the Photo Likeness feature.
19. Governing Law
These Terms and any dispute arising out of or relating to these Terms, the Site, or the Services are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws principles, except to the extent applicable law requires otherwise.
20. Dispute Resolution
Agreement to Arbitrate
To the extent permitted by applicable law, you and Tiny Tunes agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual action in small claims court where permitted.
This arbitration agreement is intended to be interpreted broadly, subject to applicable law.
Class Action Waiver
To the fullest extent permitted by applicable law, you and Tiny Tunes agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, or representative action.
You waive any right to participate in a class action lawsuit or class-wide arbitration to the extent such waiver is enforceable under applicable law.
Venue
If a dispute is not subject to arbitration, or if a party properly opts out where permitted, the dispute will be brought in a court with appropriate jurisdiction, subject to applicable law.
Opt-Out
You may opt out of the arbitration agreement by emailing support@tinytunesongs.com within 30 days of first accepting these Terms.
Your email must clearly state that you wish to opt out of arbitration and include sufficient information for us to identify the applicable customer or order.
If you opt out of arbitration, disputes will instead be resolved in a court with appropriate jurisdiction, subject to applicable law.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, technology, privacy practices, legal requirements, or business operations.
When we update these Terms, we will revise the "Last updated" date above.
Changes become effective when posted unless a different effective date is stated.
Your continued use of the Site or Services after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
22. SMS notifications.
By checking the box and entering your mobile number when requesting a free movie preview, you agree to receive up to 2 text messages from TinyTunes about that order. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages. Questions: support@tinytunesongs.com.
